This privacy policy explains the processing of your personal data (Art. 4 No. 1 GDPR) by TEMOT International Autoparts GmbH, Europaring 60, 40878 Ratingen, Germany, ("we" or "TEMOT") as data controller (Art. 4 No. 7 GDPR) in the context of accessing the elearning website TEMOT TechMasters, available at https://techmasters.temot.com/ ("TechMasters"), and your rights under the GDPR.

Processed Data and Purposes of Processing

Processing of personal data you provide

We process personal data that you actively provide to us. For example, if you contact us via email or telephone. The legal basis for this processing of your personal data is Art. 6 (1) b) GDPR.

Log data

When accessing TechMasters, certain personal data, including data sent by the browser (e.g., IP addresses, types of cookies, previous website, time and date, content displayed) are temporarily stored. We use this log data to enable you to use TechMasters and, if necessary, to check and enforce our rights and the rights of third parties in the event of damage or infringement of legal regulations, our terms of use and the rights of third parties. The legal basis is Art. 6 (1) f) GDPR. The log files are stored for as long as is necessary for the respective purpose, generally no longer than 14 days.

Registration and Login via Single Sign-On

When you register to TechMasters using a third-party account via Single Sign-On, you will be redirected to the page of the respective provider for login, where you must log in with your account data. As a result, your account with the respective provider will be linked to TechMasters. In the process, we receive certain information from the respective provider, including personal data from you (depending on the provider, in particular your surname, first name, email address). This information is necessary for us to identify you and provide you with improved services.

Conversely, the provider used for the Single Sign-on process receives information about how you use TechMasters, including your login status, browser information, your device, websites you visit, and advertisements displayed to you, your IP address and other data, if applicable. The third-party provider or its server may be located outside the EU (e.g., in the USA).

For data processing in connection with the Single Sign-On process, you must give your consent, based on which the processing is carried out in accordance with Art. 6 (1) a) GDPR.

Integration of YouTube videos

We have integrated YouTube videos into our service using YouTube API Services, which are stored on YouTube.com and can be played directly from the TechMasters interface. The legal basis for the display of the videos is your consent (Art. 6 (1) a) GDPR).

By accessing TechMasters, YouTube receives the information that you have accessed the corresponding subpage of TechMasters. In addition, basic personal data such as IP address and timestamp are transmitted. This occurs regardless of whether you are logged in with a YouTube user account. If you are logged in to a YouTube or Google account, your personal data will be directly assigned to your account. If you do not want the assignment with your profile at YouTube, you must log out before accessing TechMasters. YouTube stores your data as usage profiles and uses them for the purposes of advertising, market research and/or demand-oriented design of its website.

The information collected is stored on Google servers, also in the USA. Google has, according to its own information, taken measures to ensure a sufficient level of data security and has promised to comply with applicable data protection laws concerning the international transfer of data. We have concluded socalled standard contractual clauses with Google, the purpose of which is to ensure compliance with an appropriate level of data protection in the third country.

The purpose and scope of the data collection and the further processing and use of the data by YouTube, as well as your rights in this regard and setting options for protecting your privacy, can be found in Google's privacy policy (https://policies.google.com/privacy?hl=en).

If you have marked a video as "favorite", we store this information and link it to your TechMasters account. We further store information about your last-seen videos on TechMasters. The legal basis is Art. 6 (1) (b) GDPR.

Newsletter

We offer to you the possibility to register for our newsletter on TechMasters. For security reasons, we use the so-called double opt-in procedure: After you have entered your email address in the registration field, we will send you a confirmation to that email address. Only when you click on this confirmation link will your email address be added to our newsletter distribution list. Only your email address is required to register for the newsletter. After your confirmation, we store your email address for the purpose of sending the newsletter. The legal basis is Art. 6 (1) a) GDPR. You can revoke your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can revoke your consent by clicking on the link provided in every newsletter email or by sending a message to our data protection officer (see above).

Other purposes for which we process your personal data

We process your personal data:

  • to fulfill contracts and in the context of existing or new business relationships. We will retain this personal data at least for the duration of our business relationship. During our business relationship, we may collect contact information or other data. Some data is obtained from public sources and websites. Legal basis: Art. 6 (1) b) GDPR.
  • to meet our legitimate interests (Art. 6 (1) f) GDPR), including the following:
    • enforcement of legal claims and the defense in legal disputes.
    • prevention and investigation of crime and serious misuse of our services.
    • management and development of our business, including the sending of information about services from us, unless you have expressly objected to the sending of information (e.g., direct mail).
  • to fulfill our legal obligations, court orders or other binding decisions. The legal basis is Art. 6 (1) c) GDPR.

Recipients of Personal Data

We use third-party companies to process personal data on our behalf, for example for hosting, technical support of TechMasters, sending newsletters or for analysis and advertising purposes. Such service providers only process the data on our behalf as socalled processors (Art. 28 GDPR).

Furthermore, we transmit personal data to third parties if this is required by law, necessary for the exercise and defense of legal claims or if third parties provide certain services for us (e.g., lawyers, tax consultants).

Insofar as we transfer personal data to third countries outside the EU, we ensure an appropriate level of data protection through contractual and other measures. You have the right to receive written proof of such measures.

Cookies

In addition to the processing purposes mentioned above, we also use cookies if this is technically necessary to offer TechMasters or certain content or if we are obliged to do so. The legal base for the use of necessary cookies is § 25 (2) No. 2 of the German Telecommunications-Telemedia Data Protection Act (TTDSG).

Cookies that are not technically necessary (e.g., for analysis purposes) are only processed with your consent. The legal basis for this is § 25 (1) TTDSG.

Unless otherwise stated in this privacy policy, cookies remain stored as long as necessary to fulfill the respective processing purposes. You can object to the storage of cookies by browser preferences and delete them manually in your browser settings. Please note, however, that some cookies may be mandatory for the use of TechMasters or individual functions.

Regular deletion of Personal Data

Unless a specific duration of data storage is specified in this privacy policy, we will only process your data as long as this is necessary for the respective purposes or as long as there are legal retention obligations. After the respective processing purpose ceases to apply and retention obligations end, your data will be routinely deleted.

Your Rights

You can request information about your stored data (Art. 15 GDPR). If you have provided personal data on the basis of a contract or consent, you have the right to receive this data in a standard and machine-readable format (Art. 20 GDPR).

To the extent allowed under GDPR, you can also request the deletion, correction, or restriction of the processing of your data (Art. 16, 17, 18 GDPR).

You can revoke your consent at any time without affecting the lawfulness of processing based on your consent before its withdrawal.

You can object to the processing of data processed on the basis of our legitimate interests or when the processing is carried out in the public interest at any time under the conditions of Art. 21 GDPR. In the event of such an objection, we will no longer process the concerned personal data, unless we can demonstrate compelling legitimate grounds for the processing which outweigh your interests, rights and freedoms as a data subject, or for the assertion, exercise or defense of legal claims.
